Just In: Court stops BEDC from disconnecting electricity supply to Ondo UNIMED Teaching Hospital

The Ondo State High Court sitting in Akure has ordered the Benin Electricity Distribution Company Plc (BEDC), to stop threatening to disconnect or disconnecting electricity supply to the University Of Medical Sciences Teaching Hospital, Ondo State, (UNIMEDTH).

Ruling on an Ex-parte Motion in SUIT NO: HC/AK/23/CIV/2024, filed by the hospital’s lawyer, Mr Iyiola Afolabi, the presiding judge, Justice B.J. Akinwumi held that the order against the defendant (BEDC) subsists pending the determination of the Motion on Notice.

The Motion Ex-parte and affidavit of Alo, Damilola Olatubosun, sworn to and filed on the 17 day of September, 2024 at the High Court Registry.

The lawyer had brought the Ex-parte in pursuant to order 20 Rule 1 (1) & (2), Rule 15 of the Ondo State High Court (Civil Procedure) Rules 2019 and under the inherent jurisdiction of the Honourable Court.

The lawyer earlier prayed the court that “An Order of interim injunction restraining the Defendant, its agents, servants, privies staff or officers or anybody claiming through or for the Defendant from disconnecting or threatening to disconnect electricity supply to the claimant pending the determination of the Motion on Notice.

“AND FOR SUCH further order(s) as this Honourable Court may deem fit to make in the circumstances.”

However delivering the ruling on 17th September, 2024, Justice Akinwumi held that “AND THE COURT having listened to lyiola Afolabi Esq, ordered as follows; Accordingly, it is hereby ordered as prayed. The Defendant, BEDC PLC, its agents, servants, privies, staff officers or anybody claiming through or for the Defendant is hereby restrained via interim injunction from disconnecting the electricity supply of the Claimant/Applicant pending the determination of the Motion on Notice.”
